Terms and Conditions of Use
I. GENERAL PROVISIONS and LIMITATIONS OF LIABILITY
1. www.veggofix.com (Website) is owned and administrated by VEGGOFIX FOODS SRL (Company), Romanian company headquartered in Brasov, 149 Lunga Street, identified with Trade Registry number ROONRC.J8/3565/2022 and Fiscal code 47143341. For all communication purposes please send an e-mail to contact@veggofix.com. Response time is usually 1 to 2 business days (Monday to Friday), with the exception of public holidays of Romania.
2. Visiting, using and ordering on the Website involves agreeing to the Terms and Conditions of Use and our Privacy and Cookies Policy. We reserve the right to make changes to these without prior notice, and you can always consult the most recent version of these provisions. If you do not agree with the provisions of the two, you must not use our Website.
3. The Company cannot be held responsible in any way towards any person who uses the Website or its content, other than within the limits of the articles constituting the Terms and Conditions of Use.
4. The description of the goods and services available on the Website (either images, videos, texts, etc.) are informative and do not represent a contractual obligation. The photos on the Website are for presentation purposes only and there may be differences between them and the product.
5. The Company does not assume responsibility for any errors or omissions regarding the price, stock or description of the products and can correct any errors that may occur, being able to make changes to the Website structure and its architecture at any time, without any formality and without prior notification, without specifying the reasons.
6. You have the obligation to carefully read the entire description of the purchased product(s)especially the ingredients list. If you have or think you have medical conditions or suffer from any condition that can iterfere with consuming our products, please contact your specialist doctor for guidance.
7. The Company does not assume responsibility and cannot be held responsible for damages caused by the use of products purchased through this Website in ways other than those recommended.
8. Users or visitors of the Website are forbidden to:
- use the site in any way that may cause damage to it, affect its performance or accessibility;
- use the site illegally, fraudulently or for any illegal, fraudulent or harmful purpose or activity;
- use the data collected from our Website for any direct marketing activity;
- download, modify, partially or fully reproduce the site, copy, sell/resell or exploit the site in any other way, for commercial purposes or contrary to the interests of the Company without its prior written consent.
Any unauthorized access to the Website represents the crime of unauthorized access to a computer system and will be sanctioned according to the Romanian legislation in force.
9. The Company reserves the right to close user accounts or to refuse the sale of products, at its own discretion.
10. The Company, its affiliates and its suppliers, cannot be held responsible for any delay or error resulting directly or indirectly from causes beyond the Company’s control. This exemption includes, but is not limited to: errors in the operation of Company’s technical equipment, failure of the Internet connection, failure of telephone connections, computer viruses, unauthorized access to the Company’ systems, operating errors, as well as force majeure cases stipulated by the Romanian legislation.
11. For any problems or complaints, please write to us at contact@veggofix.com. We always try to respond promptly to your reports, to analyze and quickly solve possible problems that may arise in the commercial relationship regarding our shop. Take into consideration that the Company is not obliged to respond to all e-mails send by the Website’s Users and that the Company will prioritize the emails regarding Orders. If you do not get any response in a reasonable time frame (7 – 10 working days), please re-send your message to ramona@veggofix.com.
II. INTELECTUAL PROPERTY/ COPYRIGHTS
1. The content and design of the Website, as well as any other material using the Website content (articles, design, product description, videos, etc.), belong to the Company and/or its collaborators and are protected by intellectual property legislation.
2. You may not use, reproduce or allow anyone to use or reproduce the Website materials (BRANDS, LOGOS, IMAGES, VIDEOS, TEXTS, INTERFACES) without prior written permission from the Company.
3. Creation of hyperlinks to the Website’s index pages is permitted, as long as this action does not present the VeggoFix products or the Company in a false, misleading, derogatory or offensive light. You may not use the Company logo or other graphic properties or brands as part of hyperlinks without prior written permission from the Company.
4. Please notify us of any violation of the copyright protection law at contact@veggofix.com.
III. USER REGISTRATION and PERSONAL DATA
1. In order to benefit from certain services offered by the Website, such as buying products, checking the status of your orders, receiving newsletters, writing products reviews, sending feedback etc it is recommended to create an user account. Registering requires your prior acceptance of Terms and Conditions of Use and our Privacy and Cookies Policy. These regulations constitute the contractual basis of the relations between users and the Company.
2. You are responsible for maintaining the confidentiality of the access data to your user account created on the Website and you agree to assume responsibility for all activities performed from your user account.
3. By registering as user or using the Website’ services, you will provide a series of personal data, such as your name and surname, email address, phone number, delivery address, card details (for online payments), and/or company data. You are required to provide valid data as the Company will use it for the purpose of processing orders, in its legitimate interest (commercial purpose) and to comply with a legal obligations (invoicing, fulfillment of fiscal obligations).
4. You have the obligation to provide the necessary and indispensable personal data and the refusal to provide them determines the impossibility of performing the commercial act.
5. If the data processing is not justified by a legitimate interest or to fulfill a legal obligation, you can refuse such processing or withdraw the previously granted consent, without affecting the legality of the processing carried out on the basis of the consent before its revocation.
6. Please access our Privacy and Cookies Policy to be informed about the data collected by the Company and how it is used, as well as about the rights regarding the protection of your privacy.
IV. REVIEWS POLICY
1. Users may post on the Website reviews, comments or other types of content as long as the content is not illegal, obscene, threatening, defamatory, does not incite hatred or intolerance on ethnic, religious, racial, sexual orientation grounds; does not violate the right to privacy or the protection of intellectual property; does not contain computer viruses, commercial, political communications, or other forms of spam.
2. In order to post reviews, comments, communications and other types of content, you cannot use false e-mail addresses or identities. Moreover you are legally responsible for false reviews.
3. The Company has the right, but not the obligation, to monitor, edit or delete any type of content or user activities on the Website. The Company is not responsible and does not assume responsibility for any of the materials posted by other third parties on the Website.
4. The Company has the right not to publish all reviews, comments and articles proposed by users.
5. When posting any content (reviews, comments, communications, photos, videos, etc) on the Website, you transfer the intellectual property rights, non-exclusively, perpetually, irrevocably, over the posted materials to the Company. The Company has the right to modify, reproduce, transmit, adapt, publish, distribute the materials posted by users AND use your name in relation to the posted materials, through any means of mass communication, from any country.
V. NEWSLETTER SUBSCRIPTION
1. Subscribing and unsubscribing to our newsletter is free and voluntary, and implies acceptance of the Terms and Conditions of Use. You can unsubscribe at any time by following the instructions at the bottom of each email.
2. The Company holds all rights to the content of the newsletter sent to subscribers under the same conditions as for the information published on the Website, in accordance with the provisions of these Terms and Conditions of Use.
VI. HOW TO ORDER
1. Online orders can be placed by any person of legal age or company (Buyer) creating an user account registered on the Website or by sending an e-mail to contact@veggofix.com.
2. You can buy products through the Website by selecting each product you want to purchase and click on the “ADD TO CART” button. Follow the steps required to finalize the purchase by filling the forms correctly and completely and proceed to pay via a secured online payments platform provided on the website.
3. After making the payment, you will receive by e-mail an invoice with all the data regarding your valid order. The order will be considered valid only if: the Buyer’s data are complete and correct; the products ordered by the Buyer are available; there are no errors in the system that could generate incorrect prices or ridiculous prices (eg: zero price value).
4. In case of a payment made by the Buyer for an order not validated by the Company, the Company has the right to return the amount to the Buyer’s account, being considered invalid payment.
5. Orders placed online can be canceled in the following cases:
- by the Buyer, before the order being processed by the Company (usually it takes 24 h), without mentioning any reason. This has to be done by the Buyer by sending a cancellation email to contact@veggofix.com. Following the cancellation of an order, its status in the Buyer’s account (user account) will also change.
- by the Company, by not fulfilling the order validation conditions (above mentioned) or due to discrepancies between the existing stocks and those displayed on the Website.

VII. PAYMENTS and PRICES
1. The prices for products listed on the Website, are the final purchase prices. By placing an order you are accepting the products prices, delivery costs and possible custom taxes.
2. If due to technical or human error the prices listed on the Website are lower than the Company’ set prices or if they are derisory (under 3 euros, in this case), the Company reserve its right to correct them and notify you via e-mail. In this case, you have the right to accept the corrected prices or to annul the order.
3. Currently the payment methods available for our online shop is by CREDIT CARD and by BANK TRANSFER. With the submission of the order, you are sending your credit card details only to the online payments processing company (third party, supplier of the Company). Your card will be charged immediately after your order.
4. If you prefer to order at contact@veggofix.com, the e-mail has to mention all necessary data for processing the order: name, surname, phone number, delivery address, company data (identification data, legal address, fiscal code, payment bank account/IBAN number). You are required to provide valid data as the Company will use it in its legitimate interest and to comply with any legal obligations.

VIII. DELIVERY
1. Our shipping address is in Romania and currently we deliver via third-party courier companies (The Company’ suppliers) only to European countries.
2. When you place your order, the shipping costs listed are only for parcels up to 2 kg (maximum 1.8 kg of products + packaging weight).
3. If your parcel exceed 2 kg, we will calculate the final delivery prices and inform you via phone or e-mail. Next, you will receive from us an email with the payment link to pay the price difference. If the price difference is not paid, we reserve the right to cancel your order and return the full amount paid for the order placed.
4. For European countries outside European Union – e.g. United Kingdom, Norway, Switzerland, Iceland, Liechtenstein etc, specific taxes (customs, VAT, etc) might apply. When placing an order you are agreeing to pay those taxes on delivery.
5. Shipping times can vary from 2 up to 10 business days. The delivery term is counted from the date your order was confirmed/validated by the Company. This term is indicative and can be changed for reasons independent of our will, such as the level of demand on courier companies in certain periods of the year (e.g., during the holidays, Black Friday, etc.) or delays due to unfavorable weather conditions or strikes within courier companies or any other situations beyond our fault.
6. If the goods are delivered with obvious damage caused during delivery, or items from your order are missing, please report immediately the defect/shortage to the courier company and notify us without delay at contact@veggofix.com.
7. If the package shows signs of damage, it’s dirty, torn, cut, unsealed or wet you can choose to receive or to refuse the parcel. If you do receive it, please know that VEGGOFIX FOODS can not be held responsible for any product decrease in quality or contamination. As soon as possible (preferably in the first 24 h), please send an e-mail to contact@veggofix.com to inform us about the situation.
8. The Company cannot be responsible for damages resulting from the improper use of the products after delivery.

IX. WARANTY, RETURNS and REFUNDS
1. All products sold by the Company are in the original packaging and come from sources authorized by each individual manufacturer.
2. The Buyer can refuse to receive the package containing the products purchased from the Website, or, as the case may be, can return the purchased products, in the following situations:
- the parcel has severe damage that affect the integrity or food safety of the product(s);
- the products were delivered / invoiced incorrectly;
- the products do not correspond to the description on the Website.
3. To benefit from the commercial guarantee, the Buyer has the following obligations:
- To notify the Company regarding the detected defect by e-mail at contact@veggofix.com withing 14 days of receiving the product(s);
- Not to damage the product (s) by breaking, tearing, contaminating or keeping it in improper conditions (heat above 25 Celsius degrees or moist environments);
- Not to damage the original packaging;
- Keep the invoice and the shipping documents.
Failure to comply with the above obligations will result in the loss of the right of refund.
4. After the Company received the product(s) back from you, in good conditions (not opened, not damaged, not contaminated), the Company will refund the value of the product(s) and delivery costs in your bank account in maximum 14 days from the moment the Company receive the product(s).
5. The cost of the transport for returning or replacing the product(s) is in the Company’s charge. If you choose to send the product (s) back with a courier not designated by the Company, the return delivery cost will not be reimbursed.
6. The Buyer will not be able to return the purchased products in the following situations:
- Products that are not accompanied by shipping documents;
- Products that have been unsealed by the Buyer;
- Products that are different from those delivered to the Buyer;
- Products that have been tested, tried or used;
- Products that have broken seals or that do not have intact labels;
- Products with damaged packaging, contaminated or kept in improper conditions.
7. In any situations the refund of the amounts for the returned product(s) is made only to the Buyer’s bank account. In this sense, the Buyer will communicate in writing the IBAN account, the bank and the full name of the account holder, in order to make the transfer. The Company is not responsible for the erroneous or incomplete transmission of data for the payment of returned products.
8. If by any chance, at the moment of your order the Company cannot fulfil the order because the product(s) is/are not available anymore, the Company will inform you about this unavailability, the amount (products price and delivery price) will be available in your account in 1-30 days, depending on the bank issuing the card.
9. According to EU and Romanian consumer protection laws, any online purchase can be annulled within 14 days of receiving the order without giving any reasons, with exceptions of food products, cosmetics, underwear, any other products that cannot be returned for health protection and hygiene reasons etc. Therefore, our products are exempted from this type of return as they can be contaminated or deteriorated by improper storage and handling.
10. If there are suspicions of fraud (false orders, false claims of returns and refunds), the Company has the right to backlist a Buyer from ordering on the Website or by e-mail and to inform competent authorities.
